1. Acceptance of terms

By accessing or using Waahey's websites, applications, or related services (collectively, "Waahey's", "we", "our", or "us"), operated by Trynocode, you agree to these Terms and Conditions. If you do not agree, do not use Waahey's. These terms apply to visitors, registered users, administrators, and anyone who accesses our services.

2. Description of services

Waahey's offers software and online services for work, learning, and growth. Depending on the product you use, features may include: • AI-assisted quiz creation, live quizzes, libraries, and learning analytics • Family and classroom experiences, including child profiles managed by adults • Word clouds, surveys, and interactive audience tools • Business tools such as CRM, outreach, parsing, workforce tracking, and AI agents • Account management, billing, support, and related infrastructure Specific features, limits, and availability may vary by product, plan, and region. We may add, change, or discontinue features where permitted by law.

3. Accounts and eligibility

You may need an account to use certain features. When you register, you agree to: • Provide accurate and complete information and keep it up to date • Maintain the confidentiality of your credentials and login methods • Accept responsibility for activity under your account • Notify us promptly of unauthorized access Where a product supports child profiles or school use, a parent, guardian, school, or other authorized adult must create and manage access as required. We may suspend or terminate accounts that violate these terms or pose a security or legal risk.

4. Subscriptions, billing, and trials

Paid plans, trials, and usage limits are described at the point of purchase or within the relevant product. By subscribing, you authorize us and our payment providers to charge applicable fees, taxes, and renewals according to your plan. Fees are generally non-refundable except where required by law or explicitly stated in a product offer. We may change pricing or plan features with notice where required. 5. AI-generated and user-provided content

Some Waahey's products use artificial intelligence to process content you provide and generate outputs such as questions, summaries, visuals, or responses. You acknowledge that: • AI outputs may be incomplete, inaccurate, or inappropriate for your specific context • You are responsible for reviewing outputs before relying on or sharing them • Waahey's does not guarantee the accuracy, legality, or suitability of AI-generated content • Outputs are provided on an "as available" basis for your requested use You must not use AI features to generate unlawful, harmful, or infringing content.

6. Your content and intellectual property

6.1 Your content: You retain ownership of content you upload or submit, subject to rights you grant us to operate the services. 6.2 License to Waahey's: You grant Trynocode a limited, non-exclusive, worldwide license to host, process, reproduce, display, and use your content solely to provide, secure, and improve the services you use. 6.3 Waahey's property: The Waahey's name, logos, software, designs, documentation, and other platform materials are owned by Trynocode or its licensors. You may not copy, modify, distribute, sell, or reverse engineer our services except as allowed by law or written permission. 6.4 Feedback: If you submit suggestions or feedback, we may use them without obligation to you.

7. Acceptable use

You agree not to: • Violate laws or third-party rights, including intellectual property and privacy rights • Upload malware, attempt unauthorized access, or disrupt our systems • Scrape, crawl, or automate access in ways that burden or circumvent our services • Harass, defame, discriminate, or distribute unlawful or harmful material • Misrepresent your identity or affiliation • Resell or commercially exploit the services without authorization • Use the services to process sensitive personal data without lawful basis and appropriate safeguards We may investigate violations and take action, including content removal and account termination.

8. Privacy

9. Third-party services

Waahey's may integrate with or link to third-party services. Those services are governed by their own terms and policies. We are not responsible for third-party products, websites, or practices unless expressly stated.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAAHEY'S IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the services will be uninterrupted, error-free, secure, or free of harmful components, or that results will meet your requirements.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRYNOCODE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF WAAHEY'S. Our total liability for any claim arising out of these terms or the services will not exceed the greater of (a) the amounts you paid us for the relevant service in the twelve months before the claim, or (b) one hundred U.S. dollars (USD 100), except where liability cannot be limited by applicable law.

12. Indemnity

You agree to defend, indemnify, and hold harmless Trynocode and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the services, or your violation of these terms or applicable law.

13. Changes to these terms

We may update these Terms and Conditions from time to time. We will update the "Last updated" date and provide additional notice when required. Continued use after changes take effect constitutes acceptance of the updated terms.

14. Governing law and disputes

These terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory local consumer laws apply. Disputes arising from these terms or Waahey's shall be subject to the exclusive jurisdiction of the courts located in India, unless applicable law requires otherwise.
